Terms of Service

1. Acceptance of Terms

By accessing or using Neighbor-Pool (“the Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time; continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

Neighbor-Pool is a community service consolidation platform that groups households within a geographic area to collectively negotiate discounted rates with service providers. The Service includes:

  • A resident sign-up portal accessed via unique QR codes assigned to addresses
  • Collection of service preferences and contact information
  • An administrative portal for neighborhood organizers
  • Coordination between resident groups and vetted service providers

Neighbor-Pool acts as a facilitator and does not itself provide home services. All services are delivered by independent third-party providers.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The Service is available to residents of the United States only.

4. Registration and Account

Signing up for Neighbor-Pool requires providing a valid email address and selecting service preferences. You are responsible for maintaining the accuracy of the information you provide. Your sign-up is non-binding — you will not be committed to any service or payment until you explicitly accept a confirmed group rate offer.

5. No Commitment Until Acceptance

Submitting your email and service preferences through Neighbor-Pool does not create a contract for services. A binding commitment only arises when: (a) a group rate is confirmed with a provider; (b) you receive a separate offer detailing the price and terms; and (c) you explicitly accept that specific offer. You may opt out at any time before accepting a confirmed offer.

6. Third-Party Service Providers

All home services facilitated through Neighbor-Pool are performed by independent third-party providers. Neighbor-Pool vets providers for licensing, insurance, and background checks but does not employ or directly supervise these providers. Neighbor-Pool is not liable for the quality, timeliness, or safety of services rendered by third-party providers. Disputes regarding service delivery should be directed to the provider and, if unresolved, to Neighbor-Pool for mediation assistance.

7. Acceptable Use

You agree not to:

  • Provide false or misleading information during sign-up
  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service or its associated infrastructure
  • Attempt to access any portion of the Service not intended for you
  • Use automated means to access the Service without our express permission
  • Reproduce, resell, or exploit any portion of the Service without authorization

7a. Provider Referral Feature

Neighbor-Pool offers an optional “Invite My Pro” feature that allows residents to recommend a service provider they already use. By submitting a provider's name and email through this feature, you represent that:

  • You have a genuine prior relationship with the provider you are recommending
  • You reasonably believe the provider would welcome this communication
  • The email address you provide belongs to the intended recipient
  • You are not using this feature to send unsolicited commercial messages to strangers

Neighbor-Pool is not responsible for outcomes resulting from referrals, including whether the referred provider applies, is selected, or performs to expectations. Referral does not guarantee matching or service delivery. We reserve the right to disable this feature for any account misusing it.

7b. Provider Accounts

Service providers who create accounts on Neighbor-Pool agree that:

  • All information submitted (licensing, insurance, service areas, pricing) is accurate and current
  • They maintain all licenses and insurance required by applicable law throughout the term of any active deal
  • They will perform services as described and agreed upon with the resident group
  • Neighbor-Pool may suspend or terminate provider accounts for misrepresentation, poor performance, or violation of these Terms
  • Group pricing bids submitted through the platform are binding offers for the stated duration

8. Payment and Refund Policy

  • Payment timing — payment for confirmed group deals is processed via Stripe when you accept a provider offer. Funds are held until service delivery is confirmed.
  • Provider cancellation — if a provider cancels after payment, you will receive a full refund within 5-10 business days.
  • Resident cancellation — you may cancel before service delivery for a full refund. Cancellations after service commencement may be subject to a partial charge.
  • Disputes — payment disputes should be submitted to contact@neighbor-pool.com within 7 days of service delivery.

9. Administrator Responsibilities

Users granted access to the Neighbor-Pool administrative portal (“Admins”) are responsible for: accurately entering residential address data; distributing flyers and QR codes only to residents of the addresses entered; maintaining the confidentiality of any admin credentials; and ensuring compliance with applicable privacy laws when collecting resident information.

10. Intellectual Property

All content, trademarks, logos, and materials associated with Neighbor-Pool are the property of Neighbor-Pool or its licensors. You may not reproduce, distribute, or create derivative works from any part of the Service without express written permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NEIGHBOR-POOL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC GROUP RATE WILL BE ACHIEVED. USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEIGHBOR-POOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF SAVINGS, SERVICE DISSATISFACTION, OR DATA LOSS. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) FIVE HUNDRED DOLLARS ($500) OR (B) THE TOTAL FEES OR AMOUNTS PAID BY YOU TO NEIGHBOR-POOL IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

13. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Austin, Texas.
